TERMS OF
SERVICE

Welcome to Rookia. These Terms of Service ("Terms") govern your access to and use of the Platform operated by Rookia Tecnologia Ltda. ("Rookia", "we", "us", or "our"), including the website at rookia.com and any related applications or services.

By creating an account, registering for an event, or otherwise using the Platform, you agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Platform.

These Terms apply to all Users of the Platform, including Athletes, Event Organizers, Staff, and Spectators.

To use the Platform, you must:

• Be at least 18 years of age; or
• If under 18, have obtained verifiable consent from a parent or legal guardian, who also agrees to be bound by these Terms on your behalf;
• Have the legal capacity to enter into a binding agreement in your jurisdiction;
• Not be prohibited from using the Platform under applicable law.

By registering, you represent that you meet these eligibility requirements. Rookia reserves the right to suspend or terminate accounts that do not comply.

3.1 Account Creation

To access certain features of the Platform, you must create an account. You may register directly with an email address and password, or via a supported social login provider (currently Google; Apple support may be added in the future).

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate, current, and complete information during registration;
• Keep your account information up to date;
• Notify us immediately at contact@rookia.com of any unauthorized use of your account or any other security breach;
• Never share your password with any third party.

Rookia is not liable for any loss or damage arising from your failure to safeguard your account credentials.

3.3 One Account Per Person

Each individual may maintain only one personal account. Event organizers may create a separate organizational account for their entity.

4.1 For Athletes and Competitors

Athletes may use the Platform to: create a public athlete profile; register for competitions managed through the Platform; view their competition history, scores, and rankings; and connect with event organizers and other participants.

4.2 For Event Organizers

Event organizers may use the Platform to: create and manage competitions and events; set registration requirements, categories, divisions, and schedules; publish rulebooks and event information; collect athlete registrations and manage entry fees (via third-party payment providers); publish and manage competition results; and communicate with registered participants.

4.3 For Staff

Staff members (judges, referees, volunteers) may be granted access to specific event management tools by an Event Organizer. Their access and permissions are defined by the Organizer and are subject to these Terms.

4.4 For Spectators

Spectators may access publicly available content on the Platform, including event results, rankings, athlete profiles, and event information, without creating an account.

Event Organizers using the Platform to manage competitions acknowledge and agree that:

• They are solely responsible for the content, accuracy, and legality of their events, including registration information, rules, schedules, and results;
• They will comply with all applicable laws and sporting regulations in the jurisdictions where their events take place;
• They are responsible for obtaining any necessary permits, licenses, or authorizations to hold their events;
• They are independent data controllers with respect to personal data they collect from athletes and participants through the Platform, and are responsible for complying with applicable data protection laws (including LGPD and GDPR) in relation to such data;
• They will not use athlete data collected through the Platform for any purpose other than event management without the explicit consent of the relevant athletes;
• Entry fees collected through the Platform are subject to the terms of the applicable third-party payment provider (e.g., Stripe), and Rookia is not responsible for payment disputes between Organizers and participants.

6.1 User Content

You may submit, upload, or publish content on the Platform, including profile photos, competition results, comments, and event information ("User Content"). By submitting User Content, you:

• Represent that you own or have the necessary rights to submit it;
• Grant Rookia a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and promoting the Platform;
• Acknowledge that publicly submitted content (such as results and athlete profiles) may be viewed by any visitor to the Platform.

6.2 Prohibited Conduct

You agree not to use the Platform to:

• Submit false, misleading, or fraudulent information, including inaccurate competition results;
• Impersonate any person, athlete, or organization;
• Harass, intimidate, or harm other users;
• Upload or transmit harmful, offensive, defamatory, or illegal content;
• Attempt to gain unauthorized access to any part of the Platform or other users' accounts;
• Interfere with or disrupt the Platform's operation, servers, or networks;
• Use automated tools (bots, scrapers, crawlers) to extract data from the Platform without prior written consent from Rookia;
• Violate any applicable local, national, or international law or regulation.

Rookia reserves the right to remove any content and suspend or terminate any account that violates these Terms, without prior notice.

Competition results, rankings, athlete profiles, event information, and rulebooks published on the Platform may be publicly visible to any visitor without requiring a login. By participating in events managed through the Platform, athletes acknowledge and consent to the public display of their competition results and athlete profile.

Spectators and other third parties may not reproduce, republish, or commercialize publicly available content from the Platform without Rookia's prior written consent.

8.1 Event Registration Fees

Some events on the Platform may require payment of a registration fee set by the Event Organizer. All payments are processed by a third-party payment provider (e.g., Stripe). Rookia does not directly handle or store your credit card or financial account information.

8.2 Refund Policy

Refund policies for event registration fees are set by the individual Event Organizer and communicated to participants at the time of registration. Rookia is not responsible for refund disputes between Organizers and participants. For platform-level subscription or service fees (if applicable), please refer to the applicable pricing page on rookia.com.

8.3 Platform Fees

Rookia may charge Event Organizers platform or service fees for using the Platform's management tools. Such fees will be communicated clearly at the time of the transaction or subscription.

The Platform and all its content, including but not limited to the Rookia name, logo, design, software, text, graphics, and data compilations (excluding User Content), are the exclusive property of Rookia Tecnologia Ltda. and are protected by applicable intellectual property laws in Brazil, the EU, and internationally.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the Platform without prior written permission from Rookia, except as expressly permitted by these Terms.

The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Rookia does not warrant that: (a) the Platform will be uninterrupted, error-free, or secure; (b) competition results, rankings, or other data displayed on the Platform are free from errors; (c) any defects will be corrected; or (d) the Platform or its servers are free from viruses or other harmful components.

Participation in sports and physical competitions involves inherent risks. Rookia is a technology platform only and is not responsible for any injuries, accidents, or incidents that occur during events managed through the Platform.

To the maximum extent permitted by applicable law, Rookia, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or service interruption, arising out of or in connection with your use of the Platform or these Terms, even if Rookia has been advised of the possibility of such damages.

To the extent permitted by law, Rookia's total liability to you for any claims arising under these Terms shall not exceed the amount paid by you to Rookia in the 12 (twelve) months preceding the claim, or BRL 100,00 (one hundred Brazilian reais) if no such payment has been made.

Nothing in these Terms limits Rookia's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded by applicable law.

You agree to defend, indemnify, and hold harmless Rookia, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your User Content; (c) your breach of these Terms; or (d) your violation of any applicable law or the rights of any third party.

Either party may terminate the relationship under these Terms at any time:

• You may terminate your account by contacting us at contact@rookia.com or by using account deletion features within the Platform settings;
• Rookia may suspend or terminate your account and access to the Platform at any time, with or without cause and with or without notice, if we believe you have violated these Terms or applicable law.

Upon termination, your right to use the Platform ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law will survive termination.

Rookia reserves the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We also reserve the right to update these Terms at any time. When we make material changes, we will notify you by email or by a prominent notice on the Platform at least 15 (fifteen) days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of Brazil, including the Brazilian Consumer Protection Code (CDC, Law No. 8,078/1990), the LGPD, and the Brazilian Civil Code, without regard to conflict of law principles.

For users located in the European Union, mandatory consumer protection provisions of the applicable EU member state shall also apply.

Any disputes arising out of or relating to these Terms or the use of the Platform shall first be submitted to good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Sao Paulo, SP, Brazil, unless otherwise required by applicable consumer protection law.

• Entire Agreement: These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Rookia regarding the Platform.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Rookia's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms without Rookia's prior written consent. Rookia may assign its rights and obligations freely.
• Language: These Terms are provided in English. In the event of any conflict with a translated version, the English version shall prevail, except where required otherwise by local law.
